Regulations for Interlock Term

After conviction of any DUI, an interlock is required to reinstate your driver’s license. Our clients often think that after their conviction, they can still drive – but often, they have been misinformed.  Call us for guidance.

1.    Install Device

  • After the interlock is installed on your car, you MUST go to the MVD to re-instate your driver’s license. Your interlock period begins when this is done.

2.    Accuracy Checks

  • These check-ups must be performed at least once a month for the first three months, and every sixty days after until the device is removed.  There is a seven-day grace period to have device checked; if that deadline is violated, the MVD will restart your term from the beginning.

3.    Random Retests

  • You are required to take random tests while vehicle is running.
  • The first test will be 5 to 15 minutes after the vehicle is started.
  • Then a test will be required every 15 to 45 minutes after the first, as long as the vehicle is running.
  • MVD will attempt to extend your term for a year for each missed or failed retest.

4.    Zero Tolerance Fail = BAC .03% to .0799%

  • Any BAC .03% and over will not allow car to start.
  • Under 21 years of age: any BAC .03% and over is considered a violation and a year is added to the term.

5.    Violation Fail = BAC .08% and up

  • Car will not start
  • Over 21: after 2 violations in the term, you will be required to have the interlock for an additional 6 months.

  1. 1st Offense Basic DUI =                         12 months (may be eligible for 6-month deferment if qualified by MVD)
  2. 2nd Offense Basic DUI =                        12 months
  3. 1st Offense Extreme DUI =                    12 months
  4. 2nd Offense Extreme DUI =                   12 months
  5. 1st Offense Super Extreme DUI =        18 months
  6. 2nd Offense Super Extreme DUI =        24 months
  7. Class 4 Felony Aggravated DUI =        24 months
  8. Class 6 Felony Aggravated DUI =        24 months
